Terms of Service
These are the terms that govern your use of StoryPath. By creating an account, subscribing, or otherwise using StoryPath, you agree to these terms. If you do not agree, do not use StoryPath. Please read them carefully — some sections affect your legal rights.
1. About StoryPath
StoryPath is an educational service for children in Grades 1 through 5, owned and operated by StoryPath LLC, a Bardic Learning Systems, Inc. company. We are based in the United States. References in these terms to “StoryPath,” “we,” “us,” or “our” mean StoryPath LLC.
References to “you” or “your” mean the adult who creates an account — the parent, guardian, or educator. Where these terms refer to a “student,” we mean the child whose profile is on a StoryPath account.
2. Eligibility and accounts
To create a StoryPath account you must be at least 18 years old and able to enter into a binding contract. Accounts are personal to the adult who creates them. You are responsible for keeping your account credentials secure, and for any activity that takes place under your account.
You must provide accurate information when creating your account and keep that information current. If we discover that an account contains materially false information, we may suspend or terminate it.
3. Children’s accounts
Students do not create their own StoryPath accounts. As the adult account holder, you create a student profile on your account on the child’s behalf, and you set the credentials (username and PIN) that the child uses to sign in. You can change the username, PIN, or display name on a student profile from your account settings at any time.
By creating a student profile, you confirm that you are the child’s parent, legal guardian, or an educator authorized to act on the parent’s or guardian’s behalf. You also confirm that you have read and agree to our Privacy Policy, which describes what information we collect from and about students, how we use it, and how it is protected. Our handling of children’s information is governed in detail by the Privacy Policy and by our Data Retention Policy.
You are responsible for supervising your child’s use of StoryPath in a way that is appropriate for them, and for the consequences of that supervision.
4. Subscriptions, billing, and refunds
StoryPath is a month-to-month subscription service for personal accounts. Your subscription begins when you create your account and continues until you cancel it. You will be charged $13.99 per active student slot per month, plus any applicable taxes, beginning at account creation and renewing every billing cycle.
You may cancel your subscription at any time by signing in to your account and using the billing management portal. Cancellation stops billing for the next cycle. Cancellation does not refund the current billing period, prior billing periods, partial months, or any unused student slots.
StoryPath does not offer a free trial period. The first student slot is billed when the account is created, regardless of whether a student profile has been added to it.
StoryPath does not issue refunds outside of the limited circumstances required by applicable law (for example, where a payment was processed in error). Refunds are not available for dissatisfaction, partial use, or any other reason not described in this section.
Reducing your active student slot count takes effect at your next billing cycle. Slot reductions are not refunded for the current or any prior billing period.
We may change our pricing from time to time. If we increase the price of an existing subscription, we will notify you by email before the increase takes effect, and the new price will apply at your next billing cycle.
Subscriptions for StoryPath Partner organizations (schools, districts, and similar institutional accounts) are governed by separate written agreements between StoryPath and the organization. The terms in this section apply only to personal accounts.
5. Acceptable use
You agree not to:
- Use StoryPath in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to StoryPath systems, other users’ accounts, or any data not belonging to you.
- Copy, distribute, modify, or create derivative works of any part of StoryPath, except as expressly permitted in writing by us.
- Use any automated means to access, scrape, or interact with StoryPath, except as expressly permitted by a published API.
- Use StoryPath to harass, threaten, defame, or otherwise harm any person, or to impersonate any person.
- Use StoryPath to upload, share, or distribute content that infringes another person’s intellectual property, or that is illegal, obscene, defamatory, or otherwise objectionable.
- Share account credentials with anyone outside your household (for personal accounts) or your organization (for Partner accounts).
We may suspend or terminate accounts that violate these restrictions, with or without notice.
5A. Intended use of the service
StoryPath is designed for personalized educational lessons for children in Grades 1 through 5. The lessons are delivered through short interactive sessions in which a student answers questions, reads or listens to story content, and progresses through a curriculum at their own pace.
SideQuest is a feature of StoryPath that lets a student photograph their schoolwork — for example, a math problem, a worksheet, or a passage from a book — so that StoryPath can generate a short personalized lesson about that material. The photograph is transmitted directly to our AI provider for lesson generation. We do not store the photograph, the generated lesson, or a record of the SideQuest session on our servers. Our AI provider may retain the photograph briefly under standard commercial terms, and does not use it to train AI models.
SideQuest is not designed or authorized for photographing the child, other people, identity documents, financial records, medical records, or other materials containing personal information about the child or others. You agree to supervise your child’s use of SideQuest so that it is used as intended, and you accept responsibility for materials your child photographs that fall outside this intended use.
StoryPath is an educational supplement. It is not designed for and should not be used as a substitute for a complete curriculum, a credentialed teacher’s judgment, medical or psychological advice, or any decision with consequences outside the lesson itself.
6. Content and intellectual property
StoryPath, including the curriculum, the storytelling, the illustrations, the dashboards, and the software that runs them, is the intellectual property of StoryPath LLC and is protected by copyright, trademark, and other laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use StoryPath for the personal, non-commercial purpose of delivering the service to the students on your account, subject to these terms. All rights not expressly granted here are reserved.
You may submit content to StoryPath in the course of using it — for example, by uploading homework images to SideQuest or by entering preferences. You retain ownership of content you submit. You grant StoryPath a worldwide, non-exclusive, royalty- free license to use, store, process, and adapt your submitted content for the purpose of providing the service, and for the limited internal purposes of operating, maintaining, and improving StoryPath. We do not sell your content. We do not use your content to train AI models. Our AI service providers are contractually prohibited from using your content for model training.
The story content StoryPath generates for your child during lessons is created for you and your child’s use. You may print and keep it. You may not redistribute, resell, or incorporate it into a competing product.
7. Privacy
Our handling of personal information is described in our Privacy Policy and our Data Retention Policy, both of which are part of these terms by reference. The Privacy Policy governs what we collect, how we use it, who else sees it, and your rights. The Retention Policy governs how long we keep it and how we delete it.
For privacy and data-protection questions, including requests to exercise rights under applicable law, contact us at [email protected].
8. Termination
You may end this agreement at any time by canceling your subscription and closing your account. Cancellation takes effect at the end of the current billing cycle; billing stops for the next cycle, subject to the no-refund terms in Section 4.
We may suspend or terminate your access to StoryPath, in whole or in part, at our discretion, including for violations of these terms, for non-payment, or to comply with applicable law. Where practicable, we will provide notice before termination, but we may act without notice where required to protect students, other users, the integrity of the service, or to comply with law.
On termination, your right to access StoryPath ends. Data retention following termination is governed by our Data Retention Policy.
9. Disclaimers
We work hard to make StoryPath a useful learning tool, but we cannot promise it will be perfect for every student or that it will be available without interruption. The legal language in this section explains the limits of our warranties.
StoryPath is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, StoryPath LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that StoryPath will be uninterrupted, error-free, secure, or that the educational content will be appropriate for every student. We take reasonable steps to ensure that the content StoryPath generates is age-appropriate, but we cannot guarantee suitability for every individual student.
StoryPath is an educational supplement and is not a substitute for a complete, jurisdiction-specific curriculum, for a credentialed teacher’s judgment, or for professional advice. Educational outcomes depend on factors beyond StoryPath’s control. We do not warrant any particular result, including any specific improvement in a student’s academic performance.
10. Limitation of liability
We hope you have a great experience with StoryPath, but the law requires us to be specific about what we are and are not responsible for if something goes wrong. This section explains the limits of our liability.
To the maximum extent permitted by law, StoryPath LLC and its directors, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or relating to your use of StoryPath, including loss of profits, loss of data, loss of goodwill, or service interruption, whether based on warranty, contract, tort, or any other legal theory, and whether or not StoryPath has been advised of the possibility of such damages.
To the extent that the foregoing exclusion is held unenforceable, and to the maximum extent permitted by law, our total cumulative liability for all claims arising out of or relating to these terms or your use of StoryPath will not exceed the greater of (a) the total amount you have paid us in the twelve months preceding the event giving rise to the claim, or (b) one hundred U.S. dollars.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.
11. Indemnification
We do not expect this to come up, but if your use of StoryPath causes a legal claim against us — for example, because someone alleges your child’s content infringed their rights — we need you to defend us against it.
You agree to defend, indemnify, and hold harmless StoryPath LLC and its directors, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your violation of these terms, your misuse of StoryPath, or your infringement of any third party’s rights.
12. Changes to StoryPath and to these terms
StoryPath will change over time. We may add features, improve existing ones, or in some cases discontinue features that no longer serve our students well. Where a change significantly reduces the service, we will tell you as soon as we can — not at the moment we turn it off.
We may also update these terms from time to time. When we do, we will update the effective date at the top of this page. Material changes will be communicated to account holders by email at least thirty days before they take effect. By continuing to use StoryPath after a change takes effect, you accept the revised terms. If you do not agree to a material change, you may cancel your subscription before the change takes effect, and your subscription will end at the close of the current billing cycle without further charge.
13. Governing law and disputes
These terms are governed by the laws of the State of Arizona, without regard to its conflict-of-laws principles. Subject to your rights under applicable consumer-protection laws that cannot be waived, you and StoryPath agree that any dispute arising out of or relating to these terms or to StoryPath will be resolved exclusively in the state or federal courts located in Maricopa County, Arizona, and you and StoryPath consent to the personal jurisdiction of those courts.
14. Miscellaneous
These terms, together with our Privacy Policy and Data Retention Policy, are the entire agreement between you and StoryPath LLC relating to the use of StoryPath. If any provision of these terms is held unenforceable, the remaining provisions will remain in full force, and where permitted by law the unenforceable provision will be modified to the minimum extent necessary to make it enforceable. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign these terms without our prior written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
